At war over which school your child should apply to?

We all have different views on the benefits of state schools versus private schools, or rural schools versus city schools but in truth, the school chosen should be based on which one can best meet your child’s needs.

Communicating with your ex-partner is seldom easy and it takes a lot of patience and understanding for both parents to reach an agreement they are happy with. One of the most important decisions you will make for your child is which school they will attend, and a difference of opinion can lead to significant problems, all the while with a looming deadline ahead.

Our children law experts are well versed on disputes regarding a child’s education and can guide you from initial negotiations, through to a court application. We are able to research your preferred school and put together a written argument, setting out the benefits of your child attending your chosen school.

You usually have to apply for a school place at least 6 months before their expected start date. However, discussions should begin long before then, especially if the relationship between you and your child’s other parent is strained. If, despite lengthy discussions, no agreement can be reached, you may not be aware, but the Court can make the decision for you. The Court will always want parents to attempt to reach an agreement without their involvement, but we recognise this is not always possible.

We can support you in making an application to Court for a ‘specific issue’ order, inviting the Court to adjudicate on which school your child should attend. Be prepared to file evidence with the Court setting out why your chosen school is the right one for your child – do your research. We will help you every step of the way so that the stress and worry can be lifted from your shoulders.
