Do you need to check your employee’s driving licences?
Do you employ people who drive as part of their employment, whether in company vehicles or in their own vehicles? If so you may have been in the habit of checking their driving licences for endorsements.
From Monday 8th June 2015 details of endorsements and bans from driving will not be placed on the paper counter part driving licence (which is being phased out) or on the old paper style only driving licence. Instead records will now be kept online only.
Each individual will be able to access their own online driving licence page, showing their own personal online driving record. If you need to check an individuals driving record for your insurance purposes then you will need to ask the employee to show you their personal online driving record.
There is a facility for the registration of a share driving licence service. Under that scheme the individual can generate a unique code, which will allow you as a third party with their permission to check the driving record.
You should not access an employee's online driving record without their permission as that is a criminal offence.
If you require further guidance or believe it would be appropriate to amend your terms and conditions of employment to deal with a new digital driving licence records then please contact Paul Garner on 01945 428008 or by e-mail at paul.garner@mcp-law.co.uk.
