Applications To The Court of Protection
Our recent experience leads us to believe that increasing numbers of applications are being made to the Court of Protection for the appointments of Deputies. A Deputy is the term given to a person who manages either someone’s financial property and affairs, or issues of personal welfare, where the person in question is no longer able to manage those things themselves and there is no valid Power of Attorney in place.
Applications to the Court of Protection for the appointment of a Deputy, of whatever nature, are relatively complex. They require medical evidence and as much detail as possible concerning the, so called, patient’s circumstances. A large number of applications for Deputyship are unsuccessful, indeed something in the region of 80% being unsuccessful in Deputyship (Personal Welfare) applications.
